Section 98 emergency support

Emergency support under section 98 of the Immigration and Asylum Act 1999 can be provided to a person who has claimed asylum and appears to be destitute whilst they await a decision on their application for section 95 support.

Typically, accommodation will be full-board, such as in a hotel, and financial support will usually only be provided via an ASPEN card once section 95 support is granted.

Section 98 support will be withdrawn following a decision on 95 support. If a request for section 95 support is rejected then section 98 support can end the next day.

For more information on Section 98 support please see the Asylum Support Appeals Project factsheet or the Right to Remain Toolkit.
