To qualify for Schedule 10 support, a person must:
- be subject to immigration bail
- have a bail condition requiring them to live at a specified address, or require accommodation in order to comply with bail conditions
- have exceptional circumstances that require support to be provided
Exceptional circumstances
A person will have exceptional circumstances if one of the following applies:
- they have been granted immigration bail by the Special Immigration Appeals Commission (SIAC) and are required to live at a specified address
- they have been assessed as presenting a high risk of causing harm
- accommodation is necessary to avoid a breach of their human rights because of their situation of destitution
A person living in the community may be able to qualify on human rights grounds where they can show that:
- they are not eligible for any other support, including Home Office asylum support or support from their local authority social care service
- they do not have accommodation or the means to obtain it
- they have a pending immigration application or appeal, or there is another legal or practical barrier preventing them from leaving the UK
Examples of a legal or practical barrier include:
- a pending immigration application or appeal
- a medical condition that prevents travel
- an inability to obtain the documents needed to return
Who cannot apply?
Schedule 10 support is not available to people who are eligible for other forms of support. This includes:
Schedule 10 support is not available to families. Families who require accommodation and financial support may be able to access support from children's social care.
Exceptions
Some people who have previously claimed asylum may still be able to access Schedule 10 support because they are not eligible for asylum support. This may include:
- a person whose asylum claim was withdrawn
- a former unaccompanied asylum-seeking child who no longer qualifies for leaving care support from the local authority
